Samsung Galaxy Tab 7.7 … banned in Europe!
South Korean giant Samsung Electronics received mixed news as a German court ordered the sales ban on the Samsung Galaxy Tab 7.7 in the European Union.
The elder sibling Galaxy Tab 10.1N however was given a green signal after the German court found the tablet sufficiently different from the Apple iPad to be acceptable for healthy competition. The younger sibling Galaxy Tab 7.7 wasn’t lucky and faced the brunt in Duesseldorf.
The latest ruling of an EU-wide sales ban will conflict with the recent UK ruling – where Samsung won the case for it’s patent design infringements for three Galaxy tablets including the Galaxy Tab 7.7. The Duesseldorf Higher Regional Court ruling today has ordered the extension of the ban in all the 27 European member states.
Samsung said it was disappointed for Galaxy Tab 7.7 and will take necessary steps to overturn the ban as soon as possible. For the Galaxy Tab 10.1N, Samsung said, “We welcome the court’s ruling which confirms our position that the Galaxy Tab 10.1N does not infringe Apple’s intellectual property and does not infringe laws against unfair competition.”
The extension of the ban in the entire European Union was based on the fact that the Apple-owned patents infringed were dated back to 2004. Full trials are yet to be held and the rulings are based on preliminary injunction requests.
Apple and Samsung have locked horns over design patent disputes for almost two years with the American giant fiercely defending it’s flagship products iPhone and iPad.
